The private matter of abortion in the United States has become a nationwide controversy
rooted in morality. Some believe that abortion ends an innocent life, some believe that abortion is
a woman’s right, and some believe that abortion should be allowed under particular
circumstances, but not all. The 2022 Dobbs decision overturned nearly 50 years of precedent,
including the landmark case Roe v. Wade which established abortion as a fundamental right.
Although abortion is no longer a fundamental right, the right to interstate travel remains as such
and protects a citizen’s right to freely move between states. This Note concludes that the right to
interstate travel is violated when state agencies use financial data and automated license plate
readers to track out-of-state movements of abortion seekers. States, lower federal courts, and
corporations are called upon to adopt heightened standards in protecting citizens and consumers
alike by limiting the power of warrants and subpoenas and adopting shield laws to expand the
safe harbor network.
